2. In this case, the no-fault insurance should not be a factor, since the driver of the car was clearly at fault. However, you need to talk to your insurance agent and an attorney (as unsavory as that might be). Don't wait around to do this it can be very important.

Had a head CT... can't show a concussion
Getting MRI soon...

the stupid Florida No-Fault laws do NOTHING for motrocycles, because under that section, a motorcycle is not a motor vehicle, because it is "self-propelled" and has "less than 4 wheels"

When the person that hits you has no bodily injury liability coverage (not mandated by the no-fault law) your insurance has to pay all the bills. Well, you can't get PIP on a motorcycle in Florida!
Yes there is UM/UIM, but it costs a fortune! and is usually too little to cover all the real costs. Also, unless the at-fault driver has assets, who will pay the rest? (Remember, the insurance company willl go after the at-fault driver to cover what they paid, already.. everyone else gets 'what's left')
You have a contract with your insurer, and they don't have to give you one penny more than the fine print states. Personal Injury lawsuits are a crock, because unless the 'guilty party' has deep pockets, you're generally out of luck... the best Personal Injury attorneys just find as many people to blame and lay fault on as possible... no matter how tenous the connection or weird/minor the transgression.
And our Benevolent Lawmakers and Generous Insurers lull us into thinking that if we're good guys, they'll take care of us, then we'll be alright..
Can't you tell that "Houston, we have a problem"???
The way the laws are written, the privilege to ride a motorcycle comes with the need for insurance that costs more than the bike itself!
Because motorcycles and the people that ride them are bad.

Live, love, ride while you can -
